You can apply for the loss carryback to be limited from 2019 to 2018.

If you make a loss on a private sale transaction, you can offset this loss against profits from other sale transactions without limit. However, the losses cannot be offset against positive income from other types of income in the same year.

However, the loss carryback is an option:

(1) If you have made a loss from sales transactions, the tax office will automatically carry this loss back in full to the previous year. However, this only happens if speculative gains were also made in the previous year. If this is not the case, the tax office issues a notice of loss determination.

(2) If you do not want the automatic loss carryback or do not want it in full, you can limit the loss carryback. This limitation is useful if you expect only a small or no tax effect from the loss deduction in the previous year. Then enter "0" or the desired amount on the following page. You will receive a loss assessment notice from the tax office for the remaining loss. The loss assessment notice documents the loss carryforward for the upcoming tax year.
