The tax office does not yet accept the indication of the third gender (Diverse).

Order for married couples
In the case of married couples who file a tax return together (=joint assessment), the tax authorities have stipulated that the husband must be entered as the taxable person.

You should indicate the wife as a taxable person only if the tax return is not filed jointly and only if the tax return should be prepared for the wife in Lohnsteuer kompakt.

If the husband died in 2018 or later, enter the last name of the husband as a "taxpayer" anyway.

Order for same-sex couples and registered civil partnerships
For same-sex married couples and registered civil partners who want to file a joint tax return (= joint assessment), the tax authorities have determined who is to be declared as the taxable person:

• Enter the partner whose surname comes first in alphabetical order.
• If both have the same last name, the first name which comes first by alphabetical order is taken.
• If the first name is also the same for both, the older of the partners is taken.
